(Applicable to All SISGAIN Technologies FZE Digital Platforms and Services)

1. Agreement Between User and SISGAIN Technologies FZE

The SISGAIN Technologies FZE website and digital platforms (the “Platform”) are owned and operated by SISGAIN Technologies FZE, a company incorporated under the laws of the United Arab Emirates, with its registered office in Dubai.

Your access to and use of this Platform constitutes acceptance of these Terms and Conditions. These Terms govern your relationship with SISGAIN Technologies FZE (“SISGAIN”, “we”, “our”, “us”) in accordance with the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021), the UAE Cybercrime Law, the UAE e-Commerce Law, and all other applicable UAE regulations and international standards relevant to technology, data protection, and industry-specific compliance.

By using this Platform, you acknowledge that you have read, understood, and agreed to these Terms and the SISGAIN Privacy Policy.

2. Modification of Terms

SISGAIN Technologies FZE reserves the right to modify, revise, or update these Terms at any time. Any changes will take effect upon posting on this page. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

SISGAIN Technologies FZE operates across multiple regulated sectors and ensures that all products, software, and digital services comply with applicable UAE Federal Laws, Emirate-level regulations, and international frameworks for each industry:

Healthcare

Compliant with UAE PDPL, HIPAA (Health Insurance Portability and Accountability Act), GDPR, and NABIDH (Dubai Health Authority Health Information Exchange) standards.
Incorporates HL7 / FHIR interoperability, encryption, role-based access control, and audit trail mechanisms to safeguard electronic health records.

Aviation

Payment and claim systems adhere to PCI-DSS, ISO 27001, and data-integrity standards for secure financial processing.

Education & E-Learning

Complies with KHDA and UAE Ministry of Education policies.
Ensures student data confidentiality under PDPL and COPPA-equivalent provisions for minors’ protection.

Hospitality, Retail & E-Commerce

Adheres to UAE Consumer Protection Law, Commercial Transactions Law, and DED licensing regulations.
Payment processing is fully PCI-DSS compliant and follows UAE Central Bank’s payment gateway policies.

SISGAIN Technologies FZE maintains continuous security audits, ISO certifications, and regulatory assessments to ensure data protection, interoperability, and industry compliance across all deployed platforms.

4. Links to Third-Party Sites

The Platform may include links to third-party websites (“Linked Sites”). SISGAIN Technologies FZE does not control or endorse these sites and is not responsible for their content, availability, or data practices. Users are encouraged to review each site’s privacy and legal policies before use.

5. Acceptable Use Policy

You agree not to use the Platform for any unlawful or prohibited purpose, including but not limited to:

Uploading or distributing malware, viruses, or malicious code.
Engaging in fraudulent or misleading activities.
Violating intellectual-property, privacy, or confidentiality rights.
Transmitting obscene, defamatory, or morally offensive content under UAE law.
Attempting unauthorized access to SISGAIN systems or servers.

Any misuse may lead to suspension, termination, or legal action in accordance with UAE law.

6. Communication Services

If the Platform includes forums, chat, or messaging areas (“Communication Services”), you agree to use them only for lawful and relevant purposes. SISGAIN may monitor or remove any content that violates these Terms or UAE legal requirements.

7. User-Generated Content and Submissions

By submitting content, feedback, or ideas to SISGAIN Technologies FZE, you grant a worldwide, royalty-free, perpetual license to use, modify, distribute, and display such materials for operational and promotional purposes.

You confirm that:

You own or control all rights to the submitted material.
Your submission does not violate any law or third-party rights.

No compensation shall be provided unless expressly agreed in writing.

8. Data Protection and Privacy

SISGAIN Technologies FZE fully complies with:

UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021 – PDPL)
EU GDPR (where applicable)
HIPAA, NABIDH, and ISO 27001 / ISO 27701 standards

All personal and sensitive data are stored in secure UAE-based or regionally approved data centers. Encryption, access control, and audit trails ensure full confidentiality and integrity of user data.

9. Liability Disclaimer

All content and services on this Platform are provided “as is” and “as available”. SISGAIN Technologies FZE makes no warranties, express or implied, about the completeness, reliability, or suitability of the Platform or its contents.

To the maximum extent permitted by UAE law, SISGAIN shall not be liable for:

Direct, indirect, incidental, or consequential losses.
Business interruption, loss of data, or profit.
Errors, delays, or service interruptions.

Users are responsible for verifying the accuracy and suitability of any content or services obtained from the Platform.

10. Termination of Access

SISGAIN Technologies FZE reserves the right to suspend or terminate access without notice in case of breach of these Terms, violation of applicable laws, or any action deemed harmful to SISGAIN’s operations or reputation.

11. Intellectual Property Rights

All intellectual property on this Platform—including text, design, software, graphics, logos, and trademarks—is owned by or licensed to SISGAIN Technologies FZE and protected under UAE Federal Law No. 11 of 2021 on Copyright and Related Rights. Reproduction or redistribution without prior written consent is strictly prohibited.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. All disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

13. Copyright and Infringement Claims

If you believe that material on the Platform infringes your copyright, please contact SISGAIN at hello@sisgain.ae with supporting evidence. SISGAIN will review and act in accordance with UAE copyright law.
